Sounds like part of a Johnny Carson swami routine, but to the Democrats this is no laughing matter, as they attempt to parlay these three phenomena into a claim that John Roberts is outside the conservative mainstream (or whatever). Hugh Hewitt has some excellent comments about Judge Roberts’ opinions in the french fry and toad cases — Hedgepeth and Rancho Viejo. And earlier today, I discussed Hamdan which involved the rights of Osama bin Laden’s driver (Roberts didn’t write this opinion, but he joined it). I hope that the Senate Democrats try to spar with Roberts over one or more of these decisions. It’s usually humorous when Senator Biden or one his colleagues tries to do law.
