New York attorney Suzanne Tufts writes:
Offering to defend any “John Does” named in the Flying Imams' lawsuit is great. I’ll go one step further –- I’ld be happy to represent all the John Does and all the people on the plane, travelers and crew, in a class action suit against the Imams and their funders and backers for intentional infliction of emotional distress. There may even be some hefty Civil Rights violations, and probably a slew of other civil violations perpetrated by these performance artists against the travelers.The claim of intentional infliction of emotional distress is subject to demanding requirements under Minnesota law (assuming the court would apply Minnesota law under Minnesota choice-of-law principles), but Ms. Tufts' message represents the thought of many attorneys and lay people from we have heard.
