Chauvin Stabbed by Former FBI Informant

Featured image The facts are finally coming out on the prison attack on Derek Chauvin: The complaint states Chauvin was in the federal prison’s law library around 12:30 p.m. local time when another inmate, Turscak, attacked Chauvin with an improvised knife, stabbing him 22 times. … Corrections officers immediately responded to the assault and deployed pepper-spray to subdue Turscak, who told the responding officers that he would have killed Chauvin if they »

Derek Chauvin Stabbed In Prison

Featured image I have been in Paris for the last week; hence my fewer than usual posts. What is the biggest news in France today? Derek Chauvin was stabbed by another inmate in a medium-security federal prison in Tucson. Prison employees administered life-saving first aid, and Chauvin is now hospitalized in serious condition but expected to survive. After he was convicted, Chauvin’s lawyer requested that he be isolated from other inmates, foreseeing »

In the Chauvin case, MN Sup Ct takes a pass

Featured image Derek Chauvin petitioned the Minnesota Supreme Court for discretionary review of the Court of Appeals decision affirming his conviction for the murder of George Floyd. The Minnesota Supreme Court has now denied review. My friend Bill Mohrman represents Chauvin. Bill has forwarded the following statement: We are obviously disappointed that the Minnesota Supreme Court declined to review the criminal trial against Mr. Chauvin. The most significant issue on which we »

Speaking of Derek Chauvin

Featured image In my view, Derek Chauvin is a scapegoat for the ages. Scott wrote a little while ago about the Minnesota Court of Appeals’ turning down Chauvin’s appeal based on pretrial publicity. I would say this is one of the year’s least surprising news stories. The Court of Appeals was no more willing to risk inciting riots than the Chauvin jurors were. Unlike (I think) Scott, I believe Chauvin’s guilty verdict »

The Chauvin appeal ruling

Featured image My friend Bill Mohrmann is representing Derek Chauvin on appeal of his conviction for the murder of George Floyd. Former Acting Solicitor General of the United States Neal Katyal is representing the State of Minnesota. It’s something of a David and Goliath matchup. The Minnesota Court of Appeals was the first stop. The court held oral argument before a panel of three judges this past January. I reported on it »

The Chauvin appeal: A second look

Featured image Minneapolis attorney Marshall Tanick has taken a look at the issues raised in the Minnesota Court of Appeals hearing on the murder conviction of Derek Chauvin. Marshall discusses the hearing in the Star Tribune op-ed column “Did Chauvin get a fair trial?” I wrote about the hearing here last week. Marshall more or less provides a second opinion that aligns with mine, if somewhat faintly: [T]he core of the argument »

The Chauvin appeal hearing

Featured image When I read that Derek Chauvin had no lawyer to appeal his murder conviction to the Minnesota Court of Appeals I was incredulous. I put out the call on Power Line for an attorney to step forward to represent him on appeal in the highest tradition of the profession. Minnesota attorney Bill Mohrman answered the call. Bill is a founding partner of Mohrman, Kaardal & Erickson as well as a »

In the Chauvin appeal: Hugh Hewitt edition

Featured image Hot Air‘s Ed Morrissey — my old friend — is sitting in for Hugh Hewitt this morning. Ed had me on to talk about this post and invited listeners to check it out. Having rotated off our home page, it is easy to miss. With thanks to Ed, I am taking the liberty of reposting it. * * * * * Derek Chauvin could not afford an attorney to appeal »

In the Chauvin appeal

Featured image Derek Chauvin could not afford an attorney to appeal his convictions in the case of George Floyd. Chauvin’s insurance did not extend to appeals and the Minnesota Supreme Court denied him a public defender. Although I thought Chauvin could not have received a fair trial in Hennepin County, it looked like he wouldn’t be able to raise the issue on appeal either. I put out the call on Power Line »

The Chauvin appeal

Featured image Former Minneapolis police officer Derek Chauvin was unaccountably denied a public defender to appeal his convictions in the death of George Floyd. Bill Mohrman answered my call for a Minnesota attorney to represent Chauvin on appeal. Bill filed his brief on behalf of Chauvin this week. It is posted online here. Derek Chauvin’s mother has set up a page to support the expenses of appeal here. Bill’s leading argument on »

10 thoughts on Chauvin’s plea

Featured image The Department of Justice sent out a press release yesterday afternoon on the Chauvin plea deal following the hearing before Judge Magnuson yesterday morning. It is posted online here. The release fabricates this quote for Attorney General Garland: “Defendant Chauvin has pleaded guilty to two federal civil rights violations, one of which led to the tragic loss of George Floyd’s life,” said Attorney General Merrick B. Garland. “While recognizing that »

At the Chauvin plea hearing

Featured image I’m inside the Jury Assembly Room of the Warren E. Burger Federal Building in St. Paul, where I viewed the Derek Chauvin plea hearing by video livestream this morning. I couldn’t keep up with the proceeding working on my phone. The hearing concluded just after 9:30 a.m. (Central). I am writing on my laptop following Judge Magnuson’s adjournment of the hearing. I just have few points to offer at this »

Covering the Chauvin plea hearing

Featured image Derek Chauvin is to appear at a 9:00 a.m. hearing in St. Paul’s Warren E. Burger Federal Building this morning to change his plea in the federal civil rights charge brought against him in the Floyd case. Late yesterday afternoon I was advised by the court that I would be afforded a seat to cover the hearing from the Jury Assembly Room (JAR), which will include a livestream of the »

Derek Chauvin to plead

Featured image Having been convicted of the murder of George Floyd in state court, Derek Chauvin was charged by federal authorities with the violation of the Floyd’s civil rights. Federal authorities also charged the three other officers involved in Floyd’s arrest. The charges are pending before Judge Paul Magnuson in federal court in St. Paul. The federal proceedings seem to me both untoward and unwarranted. In the Chauvin case, they are duplicative. »

Derek Chauvin finds a lawyer

Featured image I wrote here (October 6) and here (October 7) about former Minneapolis Police Department Officer Derek Chauvin’s lack of legal representation on appeal of his conviction of George Floyd’s murder. Chauvin continues to be represented by Eric Nelson in the federal civil rights prosecution brought by the Department of Justice, but Nelson’s representation has terminated in the state court case that convulsed the Twin Cities. I summoned the spirit of »

Derek Chauvin still needs a lawyer

Featured image Yesterday I put out the call for an attorney to represent Derek Chauvin on appeal of his conviction of the murder of George Floyd. In my post I noted that Chauvin’s request for a public defender to represent him on appeal had been denied and that his appeal of that determination was pending before the Minnesota Supreme Court. The court’s filings in Chauvin’s case are accessible here. Chauvin’s in forma »

Derek Chauvin needs a lawyer

Featured image Joe Tamburino is a Minneapolis lawyer who specializes in criminal defense. He observed the trial of Derek Chauvin from beginning to end in order to provide the commentary that accompanied Jason DeRusha’s coverage of WCCO TV’s online streaming of the trial. Last month Chauvin filed an appeal of his conviction and sentence. In the Star Tribune this morning Tamburino has a column pointing out that Chauvin has some strong legal »
