York on Estrada

Byron York for National Review Online on the latest developments in the battle over the nomination of Miguel Estrada to the United States Court of Appeals for the District of Columbia. With the nomination finally on the Senate floor, it appears that the Democrats’ strategy is to attempt a filibuster without appearing to do so, while the Republicans want to force the Democrats into an overt filibuster or else a vote. The Republicans seem to hold the winning hand, provided that they remain resolute. It must not be much fun to be a Democratic Senator right now.
