Keep the champagne on ice, Part Two

The other day, I suggested that the confirmation rate of President Bush’s judicial nominees, though higher than the rates of Bush I and Clinton, was no cause for celebration. Jonathan Adler at NRO’s Bench Memos provides additional reasons why the comparison is a misleading. And here’s another: presidents have an unusually tough time getting nominees confirmed during their last year or so in office. The Bush I and Clinton success rates suffer due to this phenomenon. The current president’s does not — yet.
