Our fellow Claremont fellow Professor John Eastman of Chapman University Law School testified before a subcommittee of the Senate Judiciary Committee this week. In contrast to E.J. Dionne, Professor Eastman provides testimony that is full of straight talk about the serious constitutional issues raised by the Democrats’ use of the filibuster to obstruct confirmation of the president’s judicial appointments: “Judicial nominations, filibusters, and the Constitution: When a majority is denied its right to consent.” Listeners of Hugh Hewitt’s syndicated radio program will recognize Professor Eastman as one-half of the team Hugh calls “the smart guys.” (Courtesy of Melanie Marlowe.)
