Jennifer Braceras of the U.S. Commission on Civil Rights reminds us that one doesn’t have to be a judge to be nominated to the Supreme Court. She provides a list of potential non-judge nominees that includes Senator John Kyl, attorney Miguel Estrada, former Oklahoma Governor Frank Keating, and Spencer Abraham who has just stepped down from the position of Secretary of Energy. Abraham is as intriguing possibility. He’s best known as a U.S. Senator and Cabinet member. But, as a Harvard law student, he helped found the Federalist Society. No organization has done more to promote conservative legal causes.
