Fakiest news of 2018

Featured image McClatchy News reporters Greg Gordon and Peter Stone are the authors of the latest version of the Russia hoax story featuring Trump attorney Michael Cohen’s putative trip to Prague to work out the details of the Trump campaign’s collusion with the friends of Vladimir Putin. The story is more of the same bushwa they have been peddling for some time (see below). The byline of Gordon and Stone is a »

Fake news: Two case studies

Featured image I was asked by our local chapter of the Cardozo Society — an affinity group of Jewish lawyers of which I am a member — to speak over lunch as a counterpart to ABA Foundation Fellow and historian Victoria Saker Woeste on the subject of fake news at the society’s October 8 continuing legal education program. Ms. Woeste was the featured speaker. Her theme was that the term “fake news” »

Notes on fake news (1)

Featured image On Monday I am scheduled to make a presentation on the subject of “fake news” to our local Cardozo Society chapter. The society is an affinity group of Jewish lawyers. I am a member of the group. Unlike the past president of the Hair Club for Men (now Hair Club), I can’t say I’m both an owner and a client, but that’s the idea. It will make me nervous to »

Anatomy of a Fusion smear: Restatement & finale

Featured image On September 1 the Wall Street Journal published an editorial decrying the wrong done to Cleta Mitchell in connection with the Russia investigation(s). Cleta is the prominent Foley & Lardner partner and campaign finance expert. The Journal editorial is “Anatomy of a Fusion smear” (truncated but accessible here on Outline). The editorial addressed the smearing of Cleta Mitchell by Peter Stone and Greg Gordon in their March 15 McClatchy News »

Anatomy of a Fusion smear (4)

Featured image Peter Stone and Greg Gordon of McClatchy News smeared Cleta Mitchell in their story “Lawyer who worked for NRA said to have had concerns about group’s Russia ties.” The gist of the McClatchy story was false. In “Fake news: A case study,” we saw Cleta dispute the veracity of the smear directly with Stone and Gordon. “You took some unnamed source,” she noted, “you put their false statement as the »

Anatomy of a Fusion smear (3)

Featured image Peter Stone and Greg Gordon of McClatchy News smeared Cleta Mitchell in their story “Lawyer who worked for NRA said to have had concerns about group’s Russia ties.” The gist of the McClatchy story was false. Stone and Gordon have refused to support the smear with a single fact. The smear was planted by Glenn Simpson of Fusion GPS behind the veil of anonymity. The story replicates in small the »

Anatomy of a Fusion smear (2)

Featured image We are now in position to identify the hallmarks of a Glenn Simpson/Fusion GPS fabrication. The Fusion smear of Cleta Mitchell is illustrative. Cleta’s case offers a small example, but this is not a small matter. The Russia hoax giving rise to the appointment of Robert Mueller represents the case writ large. This is Glenn Simpson’s world. We’re just living in it. The Fusion smear follows a template with four »

Anatomy of a Fusion smear (1)

Featured image This past weekend I noted the Wall Street Journal editorial decrying the wrong done to Cleta Mitchell in connection with the Russia investigation(s). Cleta is the prominent Foley & Lardner partner and campaign finance expert. The Journal editorial is “Anatomy of a Fusion smear” (truncated but accessible here on Outline). It appears that the Fusion smear was planted in his accustomed style by Glenn Simpson with a few of his »

Fake news: A case study

Featured image Over the weekend I noted the Wall Street Journal editorial decrying the wrong done to Cleta Mitchell in connection with the Russia investigation(s). Cleta is the prominent Foley & Lardner partner and campaign finance expert. The Journal editorial is “Anatomy of a Fusion smear” (truncated but accessible here on Outline). Brennan In the Dock

Featured image John O’Connor, who played a part in Watergate, has a column in the Daily Caller that is a useful companion to Cleta Mitchell’s denunciation of the Mueller investigation. O’Connor suggests that former CIA Director John Brennan should be criminally prosecuted: As Watergate is inevitably compared to the present situation, we should recall what the scandal was and what it was not. The wrongdoing was rooted in abuses by the party »

More Mueller madness

Featured image It’s hard to keep up with the news related to the Mueller madness that dogs President Trump. I want to note the following items of the past day or two. The usual gaggle of New York Times reporters delivers “Lobbyist Sam Patten Pleads Guilty to Steering Foreign Funds to Trump Inaugural.” Who is Sam Patten, you may ask. Whoever he is, his sin was that he failed to register as »

Both sides not now (2)

Featured image Washington attorney Cleta Mitchell is a partner in the Washington, D.C., office of Foley & Lardner and a bona fide legal expert on the thorny federal law of campaign finance. She brings her expertise to bear on the question we examined yesterday in “Both sides not now.” She asks what is by now a rhetorical question concerning the Mueller Switch Project: “Fair-minded investigation or partisan witch hunt?” Cleta bores in »

Judge Walton to IRS: “Lay it on the line”

Featured image Among the imponderables staring us in the face in year 1 of the Trump administration is John Koskinen. Why does this man remain Commissioner of the IRS? Speaking of Obama holdovers, Koskinen is a beaut. I should have thought he was a prime candidate for sacking on day 1, though I don’t recall President Trump ever mentioning the scandals that have disgraced the IRS on the campaign trail. Koskinen has »

Catch-22, IRS style

Featured image This past Friday the D.C. Circuit Court of Appeals partly reinstated the lawsuits brought by two groups — True the Vote and Linchpins of Liberty — that had sued the IRS over its targeting of conservative or Tea Party-type organizations seeking 501(1)(c)(3) status. The court has resurrected the groups’ claims for relief enjoining the IRS against continued discriminatory treatment. The D.C. Circuit opinion is posted here and is worth reading. »

Our enemy, the state

Featured image This past April the Claremont Institute and the Federalist Society co-sponsored a panel discussion of the weaponization of the bureaucracy against the Democrats’ political opponents. They called the program “Our Partisan Bureaucracy? The IRS, the DOJ, and the Future of Political Activism” (video below and at the link). The Claremont Institute has posted the video with this description: When the first Civil Service Reform Act passed in 1883, “good government” »

Did John Podesta commit a serious ethics violation?

Featured image Richard Pollock of the Daily Caller reports that John Podesta, a key adviser to President Obama, may have violated ethical rules by helping to formulate a new White House policy that seeks to end any future drilling for oil on Alaska’s Artic National Wildlife Refuge. The ethical issue arises because just before he came to the White House, John Podesta was paid $87,000 by a foreign billionaire devoted to preventing »

A chance to get to the bottom of the IRS scandals

Featured image The Republican takeover of the Senate is rich in potential consequences. One such consequence is the opportunity to get to the bottom of the IRS targeting scandal. Cleta Mitchell, the attorney who has led the charge to uncover the truth about IRS abuses, points out that Republicans now control key Senate committee’s with jurisdiction over the matter: Finance, Judiciary, and Homeland Security and Governmental Affairs. The new chairmen are, respectively, »
