It would be easy to get the impression — and it is certainly a widely held belief — that freedom of speech has never been subject to broader protection in America. From common law libel to public obscenity to nude dancing to burning the flag, the Supreme Court has extended legal protection under the aegis of the First Amendment’s clause protecting the freedom of speech.
Professor Thomas West of the Claremont Institute and the University of Dallas — Willmoore Kendall’s old stomping grounds — begs to differ.
