As expected, a three-judge panel of the D.C. Circuit held much of the McCain-Feingold campaign finance law unconstitutional today. The Washington Post has a report.
Most surprising to me is that one of the three judges voted in favor of the statute’s prohibition against what the Post describes as “thinly-veiled issue ads on radio and television that actually serve as attacks on opposition candidates. The law banned the use of such funds to pay for those ads within 30 days of a primary or 60 days of a general election.” God forbid that anyone should criticize an incumbent during an election campaign.
